Same-sex relations are criminalized under Sections 162 and 165 of Kenya's Penal Code (in force since 1897), with penalties of up to 14 years for 'unnatural offenses' (21 years without consent) and 5 years for 'indecent practices between males'. The 2010 Constitution explicitly bans same-sex marriage. On 20 May 2026 the High Court ruled that the State cannot refuse to process gender-marker changes on trans people's documents (a narrow judicial step, handled case-by-case; the court recommended —but did not order— a trans-protection law), yet same-sex relations remain criminalized.
