A court orders a legal gender change without requiring surgery

The Taipei High Administrative Court ruled for a trans person with dual Taiwanese and US nationality whose application the household registration office had rejected in 2020 for lack of proof of surgery. She had submitted two hospital diagnoses of gender dysphoria and a US passport already identifying her as female. The court declined to apply the Interior Ministry's 2008 directive, which makes the surgical record the only necessary document, because it imposes a burden not set out in law and breaches the Constitution's proportionality doctrine. The ruling could be appealed and applied only to that case.

An international committee asks Taiwan for a gender recognition law

The independent committee reviewing Taiwan's implementation of the international covenants on civil and political rights and on economic, social and cultural rights urged the government to legislate on legal gender recognition. It said that continued reliance on an administrative order, despite the Supreme Administrative Court's 2023 ruling that mandatory surgery breaches constitutional rights, has created legal uncertainty for trans people, for the authorities and for judges.
